EXECUTIVE SUMMARY:
The applicant was discharged for Misconduct Due To Fraudulent Enlistment in late 1999.

The applicant expressed the breakup of a failed marriage and caring for a newborn child as the primary reasons
which created a hardship at that time. These life circumstances brought upon migrane headaches and
uncontrollable stress. In the absence of any firm documentation to support a fraudulent enlistment, or the
applicant’s formal request for separation from the service, the Majority Board vote has recommended an
alternate means to categorize the Narrative Reason for Separation.

Based upon available information, the majority board vote (3-2) recommends that the applicant should have
been issued a separation for the convenience of the government as a result of parental responsibilities.

The Minority Board vote (2-3) recommends that no changes are made.

With regard to the Majority Vote to recommend a partial upgrade on the reentry code: An RE3 reentry code is
not an affirmative recommendation for reenlistment, rather it represents that the applicant is not recommended

for reenlistment due to a disqualifying factor. The RE3 code may be waived based upon the policies and needs
of the gaining Service.

Propriety: Discharge was NOT proper.

Equity: Discharge was equitable.

Final Adjudication by Assistant Commandant For Human Resources: Partial relief is granted on the
following items:

24. Discharge: No change

25. Authority: COMDTINST M1000.6A, Art 12.B.12

26. Separation Code: JND

27. Re-entry Code: RE-3

28. Narrative Reason: Separation for Miscellaneous/General Reasons

The applicant received an RE-4 code that bars her from future reentry into military service. A recommendation of an RE-3H is the appropriate reenlistment code to indicate that her request to voluntary separate was due to family hardship. An RE3 reentry code is not an affirmative recommendation for reenlistment, rather it represents that the applicant is not recommended for reenlistment due to a disqualifying factor.

Normally, when a member is separated with less than 180 days of service, they are issued an ‘Uncharacterized’ discharge. Based on the limited amount of supporting documentation, and the standard of reenlistment codes issued for Adjustment Disorder separations, the Board recommends an RE3 reentry code. Final Adjudication by Assistant Commandant For Human Resources: Partial relief on the SPD code, reenlistment code, and Narrative Reason for Separation as follows: SPD code: JFY RE code:...

Without this information and based on the limited data available, the applicant’s record may better support an adjustment disorder. The Board endorses a change to that the applicant’s narrative reason for discharge to “Adjustment Disorder” with SPD code “JFY”. Discharge Honorable 27.

The applicant was issued with an entry level separation due to the inability to adapt during the first 180 days of service. The 3L is defined as ‘Entry Level Separation, must have waiver to reenlist’. The Board finds no issues with propriety or equity in this case.

The applicant’s parents were divorced and the mother relied heavily on the applicant to assist in the caring for her and other siblings. The Minority Board opinion on the applicant’s disqualifying mental health condition was not supported in the Narrative Reason for Separation. The Majority Board accepts the applicant’s assertions of being denied civilian employment based on the RE3 code.
